LABOR AND EMPLOYMENT LAW

• Defend employment discrimination litigation before Federal and State courts from pleadings through trial, in areas such as sexual harassment; race, disability, gender and age discrimination; retaliation; wrongful discharge; breach of contract; wage and hour issues; and breach of the duty of fair representation.

• Counsel management on issues arising under Title VII, ADEA, FMLA, FLSA, WARN, ADA, NLRA, RLA, ERISA, and state and local laws, including plant closings, reductions in force, wage and hour investigations, and pension and welfare fund issues.

• Represent management before the Equal Employment Opportunity Commission, and state and local discrimination agencies.

• Represent management before the National Labor Relations Board.

• Argue appeals before Federal and State courts.

• Develop and deliver custom tailored employee-training seminars in areas such as sexual harassment, work place violence, and union avoidance.

• Review and draft employee handbooks and personnel policies.

• Draft employment contracts, separation, release, non-solicitation, confidentiality  and non-compete agreements.

• Represent management at employment and labor arbitrations.

COMMERCIAL LITIGATION

• Engage in all facets of Commercial Litigation that affect our client’s businesses before the Federal and State Trial and Appellate courts in New York and New Jersey. These litigations have included disputes arising between vendors, manufacturers and service providers under claims such as breach of contract and breach of warranty.

• Regularly defend our clients against claims under New York State and Federal consumer protection statutes.

• Adapt our litigation practice to serve our clients’ particular business problems. An illustrative example of this is a recent litigation we brought under the Federal Computer Fraud and Abuse Act to protect our client from illegal intrusion of its secure internet site by a competitor.

GENERAL COUNSEL
As a natural complement to our Labor and Employment practice, we also act as an “outside general counsel” to our clients in areas such as:

• negotiating and drafting licensing and marketing agreements, commercial leases, employment and independent contractor agreements;

• advising on how to do business with bankrupt vendors and suppliers;

• protecting and defending intellectual property rights;

• selling, buying and forming family owned and small private businesses.
